Court orders Niger to reinstate sacked Rafi Council boss

A Minna High Court has ordered the Niger state government to reinstate the Chairman of Rafi local government council of the state, Alhaji Mohammed Ali Kagara, who was sacked some months ago over allegations of mismanagement of funds.
The court presided over by Justice Aliyu Maiyaki, also ordered that the chairman be paid all his entitlements and salaries for the period that he was out of office.
Maiyaki at the weekend struck out government appeal, wanting the court to revise its earlier ruling that nullified the removal of Alhaji Ali Kagara, from office, and ordered his immediate reinstatement in compliance with the earlier judgment
In dismissing the appeal filed on 13th May 2010, Justice Maiyaki said that it lacks competence and that the appellant and applicant failed to pay required filing fee. He therefore awarded the sum of N10,000 against the government, explaining that he was convinced that the respondent has certainly expended money in the case.
Ali Kagara instituted the suit against government early this year after he was removed from office by the state government, which also set up a commission of inquiry to probe the financial undertakings of the Council under his chairmanship from 2008.
He was however prevented from resuming office after the court ordered his reinstatement in May by the state government, on the ground that it had appealed against the ruling.
However, the court on Friday threw out the appeal, and directed the government to comply with the judgment and ordered his immediate reinstatement with all entitlements.
